These Terms govern your access to and use of the NearHelper website, apps, and services (the "Service"). By using the Service, you agree to these Terms.
1. The marketplace
NearHelper is a technology platform connecting clients with independent service providers ("pros"). NearHelper does not provide the underlying services; pros are independent contractors, not employees.
2. Eligibility & accounts
- You must be at least 18 and able to form a binding contract.
- You are responsible for your account information and activity.
- Phone verification is required; keep your access secure.
3. Bookings
When you book, you agree to the price shown at checkout, which may include taxes, a rush surcharge, or discounts.
4. Payments
- Payments are processed by Stripe.
- Wallet balances do not expire and are non-transferable.
- Prices and taxes are shown in your region's currency.
5. Cancellations & refunds
- More than 24 hours before service: full refund.
- Within 24 hours: a portion may be retained.
- Pro no-show: full refund.
6. Pros (independent contractors)
- Pros are independent contractors and set their own availability; nothing here creates employment or agency.
- Pros must sign the contractor agreement and are responsible for their own taxes, equipment, and legal compliance.
- NearHelper retains a commission on completed bookings.
7. Acceptable use
No unlawful activity, harassment, fraud, fee circumvention, scraping, or interference with the Service.
8. Reviews & content
You are responsible for content you submit and grant NearHelper a licence to use it to operate the Service.
9. Disclaimers & liability
The Service is provided "as is". To the maximum extent permitted by law, NearHelper is not liable for indirect or consequential damages or for the conduct of clients or pros.
10. Termination
You may delete your account anytime. We may suspend accounts that violate these Terms or for safety/legal reasons.
11. Governing law
These Terms are governed by the laws of British Columbia and applicable Canadian law.
